    1. Introduction and Acceptance of Terms

    Welcome to LusiberiaStays. These Terms of Service ("Terms") govern the access to and use of the website located at www.lusiberiastays.com ("Site") and all associated services provided by Gustavo Teixeira Cuco, a sole trader with NIF 254161278, operating under the trade name "LusiberiaStays" ("we", "us", "our"). Our Privacy Policy, available at https://lusiberiastays.com/privacy, is an integral part of these Terms and explains how we collect and use your personal data. By accessing, browsing, or using our Site and our services, you ("you", "your") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease using the Site. Please note that contacting us through the website, forms, email, or phone does not by itself create a contract, reservation, or service agreement. Any stays, property management arrangements, or other services are only confirmed through a separate written agreement between the parties.

    2. Description of Services

    LusiberiaStays primarily offers two categories of services in the Algarve (Portugal) and Andalusia (Spain): For Guests: The Site serves as a platform for finding and requesting reservations for furnished accommodation, typically for short to medium-term stays. In Portugal (Algarve): LusiberiaStays is generally responsible for the management of the listed properties and for aspects of the Guest's stay, under the legal regime of Alojamento Local. In Spain (Andalusia): LusiberiaStays typically acts as an intermediary, promoting properties managed by a local partner company. In these cases, responsibility for the operation, maintenance, and on-site aspects of the stay generally lies with the partner company, with our role primarily focused on facilitating booking and initial communication. The execution of any rental agreement will be subject to a specific contract and payment conditions communicated during the booking process. For Owners and Investors: LusiberiaStays offers property and asset management services, primarily for owners of residential properties in Portugal (Algarve). These services are generally designed to support the operation and maintenance of properties and are regulated by a Property Management Agreement.

    3. Conditions of Access and Use of the Site

    By using this Site, you agree to comply with the following conditions: Eligibility: You declare that you are at least 18 years of age and have the legal capacity to enter into binding agreements in accordance with applicable law. Truthfulness of Information: You commit to providing true, accurate, current, and complete information in all contact forms, booking requests, or other communications sent through the Site. You are solely responsible for any false or inaccurate information and for any damages that may arise therefrom for LusiberiaStays or third parties. Lawful Use and Conduct: You agree to use the Site only for its intended purposes and in accordance with the law. You are prohibited from: Using the Site for any illegal, fraudulent, or unauthorized purpose. Sending spam, unsolicited communications, or any form of advertising through our contact forms. Attempting to interfere with the proper functioning of the Site, including transmitting viruses, worms, or any code of a destructive nature. Copying, reproducing, or distributing any part of the Site or its content without our prior written authorization.

    4. Specific Terms for Guests

    Booking Process: An inquiry or booking request submitted through the Site does not constitute a confirmed booking, but rather a manifestation of interest. A booking is only considered confirmed after availability has been verified, the request has been accepted by LusiberiaStays and the initial payment has been received. We reserve the right to refuse any booking request at our sole discretion. Prices, Fees, and Payments: Prices for each stay are communicated during the booking process. Unless otherwise stated, prices are presented in Euros (€) and include water, electricity, gas, and internet consumption; there is no separate cleaning fee. Applicable taxes (including VAT, where due) will be itemized during the booking process. In Portugal, some accommodations may benefit from VAT exemption under Article 53 of the VAT Code (CIVA). Where a municipal tourist tax is due, it will be clearly indicated before confirmation. Cancellation and Refund Policy: For bookings made directly through the Site, the payment schedule, cancellation windows and refund rules are set out in the Direct Booking Terms, available at lusiberiastays.com/booking-terms, which prevail over this section. Bookings made through platforms such as Airbnb or Booking.com follow the cancellation policy shown on the platform at the time of booking. In cases of force majeure (e.g., pandemics, natural disasters, government restrictions), LusiberiaStays will assess fair solutions on a case-by-case basis.

    5. Specific Terms for Owners

    Onboarding Process: Management services are initiated through a proposal request by the Owner and a subsequent analysis by LusiberiaStays. The provision of any management service is formalized through the execution of a Property Management Agreement, which will detail the scope of services, commissions, obligations, and the duration of the agreement. These Terms are complementary to the Management Agreement. In case of conflict, the terms of the Management Agreement prevail. Owner's Obligations: The Owner declares and warrants that: They are the legal owner of the property or have the legal authority to rent it and contract management services for it. The property complies with all legal, tax, and safety requirements for rental, including holding all necessary licenses (e.g., Alojamento Local license in Portugal). They will provide all documentation proving compliance with AL regulations. The property has valid insurance that covers, at a minimum, civil liability, property damage, and fire.

    6. Content and Intellectual Property

    Ownership of Content: The content on the Site, including texts, graphics, logos, and icons, is the property of LusiberiaStays (Gustavo Teixeira Cuco) or used with permission of respective owners. Images and photographs of the properties are used with consent of their authors or legal owners. The compilation, arrangement, and design of all content on the Site are exclusive property of LusiberiaStays and protected by copyright laws. Limited License to Use: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and make personal, non-commercial use of the Site and its services. This license does not include the right to download (other than page caching), modify, reproduce, copy, sell, or otherwise exploit the Site or its content for commercial purposes without our express written consent. Trademarks: The name "LusiberiaStays" and its logos are trademarks belonging to us. They may not be used in connection with any product or service that is not ours, in any manner likely to cause confusion, or in any manner that discredits us.

    7. Limitation of Liability and Disclaimer of Warranties

    General Disclaimer of Warranties: The Site, its content, and services are provided "as is" and "as available," without warranties of any kind, either express or implied. While we strive to ensure that the information on the Site is accurate and up to date, we do not warrant that the content is error-free, complete, or that access will be uninterrupted. Limitation of Liability: To the fullest extent permitted by law, LusiberiaStays (including its representative, Gustavo Teixeira Cuco) shall not be liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of profits, data, or business interruption) resulting from: The use or inability to use the Site or our services. The cost of procuring substitute goods or services. Any conduct or content of any third party (including other users, guests, or owners). Any dispute between a Guest and an Owner. Nothing in these Terms excludes or limits our liability where such exclusion or limitation would be unlawful under applicable law.

    8. Termination

    Termination by You: You may terminate your agreement to these Terms at any time by ceasing to use the Site and our services. Termination by Us: We reserve the right to suspend or terminate your access to the Site and our services, with or without notice, at our sole discretion, for any reason, including, but not limited to: Violation of these Terms. Provision of false or misleading information. Failure to meet payment obligations. Any conduct deemed harmful to our business, reputation, or other users. Upon termination, your right to use the Site will immediately cease. Termination does not affect rights or obligations already arisen (including payment obligations).

    9. Governing Law and Dispute Resolution

    Governing Law: These Terms and any contractual relationship shall be governed exclusively by the laws of Portugal. Jurisdiction: Disputes shall fall under the exclusive jurisdiction of the courts of the District of Lisbon, with waiver of any other. If the user is contracting as a consumer residing in another EU Member State, this clause does not prejudice rights allowing them to bring an action in their country of residence. Alternative Dispute Resolution: In accordance with Law No. 144/2015 of September 8, consumers in Portugal may resort to an official Consumer Arbitration Centre (Centro de Arbitragem de Conflitos de Consumo). Additionally, the European Online Dispute Resolution platform is available at: http://ec.europa.eu/consumers/odr.

    10. General Provisions

    Entire Agreement: These Terms, together with our Privacy Policy and any specific Rental Agreement or Management Agreement signed, constitute the entire agreement between you and LusiberiaStays. Severability: If any provision is found to be illegal, void, or unenforceable, it shall be enforced to the maximum extent permissible, and the remaining provisions remain in full force. No Waiver: The failure of LusiberiaStays to exercise or enforce any right or provision shall not constitute a waiver. Changes to the Terms: We reserve the right to modify these Terms at any time. The revised version will be posted on our Site with an updated "Last Updated" date. Continued use of the Site after changes constitutes acceptance.
